These terms and conditions will apply to all transactions placed online, by e-mail, telephone or by post with Hughie Willett Machinery Ltd. Please read carefully before placing any order. All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights. By using this site you are agreeing to these terms and conditions'. All transactions with Hughie Willett Machinery Ltd. will be governed by these terms and conditions.
All references to the 'company', 'us' or 'we' will refer to Hughie Willett Machinery Ltd. All references to the customer shall mean the person or persons purchasing or agreeing to purchase products from the company. All references to the website shall include reference to all URL's owned by Hughie Willett Machinery Ltd.

Pricing Information
All prices are shown in pound sterling (£) and are plus UK VAT at the current rate unless clearly stated otherwise. It is our policy to offer products at the most reasonable price possible, however, if, due to circumstances beyond our control, we deem it necessary to alter any advertised price or specification, we reserve the right to do so without prior notice. Prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions, we reserve the right to cancel and refund orders where mistakes have been made. The prices shown are only applicable to purchases made via Hughie Willett Machinery Ltd. websites. Prices in our showroom may vary to those shown on the website. Special offers and promotions advertised in the press or other media may be excluded unless specifically advertised as available online.
Orders
We are pleased to accept orders by any of the following methods. Online transaction (secure server), e-mail (unsecure), telephone, fax and post. All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Switch and Solo. If the issuer of your card refuses to authorise full payment to us, we will not be liable for any delay and / or non-delivery of your order. We are unable to accept or process any credit/debit card orders without a valid card payment in the name of the registered cardholder. We must receive payment for the total price of the products that you order from us before your order can be processed. Once payment in full has been received by us we will confirm that your order has been received by sending an email to you at the email address you provide in your order form. Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the products ordered.
Ownership of Products
All products supplied to the customer remain the property of Hughie Willett Machinery Ltd. until final payment of all sums owing in respect of those products has been received in full by us.
Delivery
Products ordered will be delivered as soon as possible in accordance with the requested delivery service. However it may take longer if products are out of stock. We will keep you informed of any delays. Hughie Willett Machinery Ltd. shall not be held liable for any delays in delivering goods, nor shall we be liable for delays caused to customers work projects due to machinery or parts not arriving. Hughie Willett Machinery Ltd shall not be liable to customers for charges for hire of alternate machinery or labour. Hughie Willett Machinery Ltd will not be liable for compensation of any kind due to later deliver of machinery or failure of machinery. Parts that are not in stock will be ordered, these often arrive to us in 3 - 5 days and then we forward on. Obscure parts may take longer. If your product is not in stock, we will back order the product for you. When products are backordered we will contact you. You will always have the option to cancel your order if you would rather not wait.Charges for different delivery services other than those specified on the website can by obtained by contacting Hughie Willett Machinery Ltd. directly. All delivery conditions and charges are subject to change without prior notice. Every effort is made to ensure that delivery is made within the estimated time scales. All products are subject to availability. In the event that we are unable to supply your products within 28 days, we will inform you immediately and advise you of the expected delivery date.
Delivery Times
Delivery times are calculated in working days- i.e. Monday to Friday inclusive (working days do not include weekends or National Bank Holidays). In case of Bank Holidays please allow an extra 2 working days. From the Receipt of your order we will endeavour to deliver your chosen products to you within 7 working days providing the products are in stock, unless a longer delivery time is shown on the product information page. Deliveries to non- mainland UK or remote locations may take longer. Risk in the products will pass to you on delivery. Products delivered by courier should arrive between 9am and 5pm, Monday to Friday. We do everything we can to meet the delivery time specified in this section, however occasionally delivery times may be affected by factors beyond our control and cannot be guaranteed.
Shipping And Handling
Shipping and Handling are included in the delivery price shown on the website - for products going to addresses in mainland England, Wales and Scotland - unless otherwise stated in the product description. We recommend that products should be inspected before they are signed for, as products obviously seriously damaged in transit should be refused. You must notify us via email or fax within 24 hours if your products are subsequently found to be damaged. In the event of any products delivered by us being damaged in transit, or failure to match the products ordered by you, then such details must be notified by you to us within seven working days of receipt. If we receive no such notification the customer will be deemed to have accepted the products as satisfactory. We cannot be held liable for any consequential loss caused by late delivery or failure to deliver by the company's appointed carrier. Liability in such cases is limited to the value of those products, which are shown to have not been received by the customer.
Distance Selling Regulations and Cancellation
You have a right to cancel your order for any unused products purchased through the website under the distance selling regulations at any time up to the end of the seventh working day from the date you receive the ordered products. Cancellation must be with us by 5:00pm of the seventh working day and be in writing or by fax. This does not apply to any perishable products, or product personalized or made to your specification or products that by reason of their nature cannot be returned.
To cancel any product, you can fax or write to us quoting your invoice number. We do not accept cancellation by email. You must take reasonable care of the products, and must not use them. Products must be returned to us within seven days of your notice to cancel. Products must be returned to Hughie Willett Machinery Ltd. at our contact address. All products are returned at your own expense. Should you require your unwanted products to be collected, we will deduct the appointed courier’s direct costs from the refund given.
Once you have notified us that you are cancelling your contract, any sum deducted by us for the products, from your credit card, will be re-credited to your account within thirty days of your notice to cancel provided that the products in question are returned by you in and unused condition and with their original packaging.
If you cancel your contract but we have already processed the products for delivery you must not unpack the products when they are received by you and you must send the products back to us at our contact address, at your own cost and risk as soon as possible. If you have received the products before you cancelled your contract then, you must send the products back unused and with their original packaging to our contact address at your own cost and risk.
Cancellation by Hughie Willett Machinery Ltd.
We reserve the right to cancel the contract between us if we have insufficient stock to deliver the products you have ordered; we do not deliver to your area; or one or more of the products you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
Liability
If the products we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email or in writing at our contact address within 7 calendar days. If you notify a problem to us under this condition, our only obligation will be: To make good any shortage or non-delivery; To repair or replace any products that are damaged or defective; or if repair to or replacement of the products is not possible, or the cost of repair or replacement is disproportionate in the circumstances, to give you a partial or full refund for the products in question, depending on what is reasonable in the circumstances. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage, or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation.
Returns, Exchanges and Refund Policy
We want you to be entirely satisfied with every purchase made from Hughie Willett Machinery Ltd. as we aim to offer you excellent quality, value and service at all times. An invoice marked paid will be dispatched to you for all purchases. This is your proof of payment and also your guarantee.
Where products are not faulty but the customer wishes to return them after fourteen working days after the date of delivery, the products can only be returned to the company if fully re-saleable, being unopened and with any original manufacturers seals or shrink wrap in place. Such returns will be subject to a restocking charge of 25% of the original purchase price or £15.00 which ever is the greater. We regret that delivery / collection charges are non-refundable. We will accept returns within 14 days of invoice date, returned to our contact address. Returned products must be accompanied by a returns number authorisation ( see our returns page ).
We will not refund non-stock items which have been specially ordered for you unless our supplier will accept them back into their stock. We follow normal industry practice in making a 20% handling charge for returns of this nature.
You will be under a duty to take reasonable care to see that returned products are well packaged, so to avoid damage in transit. An appropriate method of return should be used. All products are returned at your own cost.
When returning any petrol powered product all oil and petrol must be drained from the engine before you release the products to a carrier. This is for the safety of the carrier firm.
After we have established that the products are unused and undamaged, you will be refunded the original cost of the products (not costs to return products to us), within 30 days. Products
Products are sold singly unless otherwise stated. Every effort is made to ensure the colours depicted on the site match as closely as possible those of the actual product. Due to technical limitations, some colours may vary.
Every effort has been made to ensure the accuracy of all information contained herein. The company makes no warranty expressed or implied with respect to accuracy of the information, including price, product editorials or product specifications. The company or its suppliers shall not be liable for incidental, consequential or special damages arising from, or as a result of, any electronic transmission or the accuracy of the information contained herein, even if the company has been advised of the possibility of such damages. Product and manufacturer names are used only for the purpose of identification.
Guarantee and Warranty
All products are covered by a full manufacturer’s warranty, the period of which varies according to the product. The warranty period starts from the date of purchase and some are conditional on the product being serviced at the recommended intervals by an approved dealer. The warranty covers faults, which may occur due to faulty components or workmanship but excludes consumable products, fair wear and tear or defects caused by accident, neglect or misuse.
In the event of a warranty claim, please return the products at your own expense with a copy of the original invoice to our contact address. Clearly identify the area or part that has failed. All products must be returned in a clean, dry condition. We will contact you after our appraisal.
Force Majeure
We will not be liable for non-performances of our obligations caused or resulting from industrial disputes or any other circumstances beyond the reasonable control of the company such as act of God, riots, civil commotion, flood, fire and legislation. If by reason of such circumstances it shall become impossible within a reasonable time for the company to wholly or partly supply the products ordered then the customer's liability will be limited to the value of the products already supplied together with any associated delivery charges.
Complaints
Any complaint can be communicated directly to Hughie Willett Machinery Ltd. We will endeavor to deal with your complaint within five working days of receipt. In the event where we cannot resolve your complaint immediately we will advise a likely time scale to you and keep you informed of any investigation.

A condensed guide to the use of your personal and business information by ourselves and at Credit Reference and Fraud Prevention Agencies
1) When you apply to us to open an account, this organisation will check the following records about you and your business partners
a) Our own;
b) Personal and business records at credit reference agencies (CRAs). When CRAs receive a search from us they will place a search footprint on your business credit file that may be seen by other lenders. They supply to us both public (including the electoral register) and shared credit and fraud prevention information.
c) those at fraud prevention agencies (FPAs).
d) If you are a director, we will seek confirmation, from credit reference agencies, that the residential address that you provide is the same as that shown on the restricted register of directors’ usual addresses at Companies House.
We will make checks such as; assessing this application for credit and verifying identities to prevent and detect crime and money laundering. We may also make periodic searches at CRAs and FPAs to manage your account with us.
2) Information on applications will be sent to CRAs and will be recorded by them. Including information on your business and its proprietors and CRAs may create a record of the name and address of your business and its proprietors if there is not one already. Where you borrow from us, we will give details of your accounts and how you manage it/them to CRAs.
3) If you are making a joint application or tell us that you have a spouse or financial associate, we will link your records together so you must be sure that you have their agreement to disclose information about them. CRAs also link your records together and these links will remain on your and their files until such time as you or your partner successfully files for a disassociation with the CRAs to break that link.
4) If you borrow and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs and FPAs to perform similar checks and to trace your whereabouts and recover debts that you owe. Records remain on file for 6 years after they are closed, whether settled by you or defaulted.
5) If you give us false or inaccurate information and we suspect or identify fraud we will record this and may also pass this information to FPAs and other organisations involved in crime andfraud prevention.
6) If you have borrowed from us and do not make payments that you owe us, we will trace your whereabouts and recover debts.
7) Your data may also be used for other purposes for which you give your specific permission or, in very limited circumstances, when required by law or where permitted under the terms of the Data Protection Act 1998.
